1. About This Website 

kaffelogic.com.au (the "Website") is owned and operated by Bevie Handcraft NZ Limited, a New Zealand limited company ("Website Operator", "we", "us", or "our"). The Website Operator is responsible for website operations, customer service, and overall management of the online store. 

All products sold on this Website are sold by Bevie Handcraft AU Pty Limited (ACN 089 830 286), an Australian proprietary company ("Seller"). By placing an order on this Website, you enter into a binding contract with Bevie Handcraft AU Pty Limited as the Seller. 

All products sold on this Website are manufactured by and are the intellectual property of Kaffelogic Limited, a New Zealand limited company ("Kaffelogic"). Kaffelogic is the brand owner and licensor of the Kaffelogic Nano 7 and all related products and accessories ("Products"). Kaffelogic is not a party to your purchase contract and is not liable to you as a consumer. 

 

2. Australian Consumer Law 

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) ("ACL").  

Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the ACL or any other applicable Australian law that cannot be excluded, restricted, or modified by agreement. 

Where the ACL applies, any limitations on liability set out in these Terms apply only to the extent permitted by law. 

 

3. Use of the Website 

By accessing this Website, you represent and warrant that you are: 

  • At least 18 years of age, or accessing the Website with the consent of a parent or guardian; and 

  • Legally entitled to access and use the Website in the jurisdiction from which you are accessing it. 

You agree not to use this Website to: 

  • Engage in any unlawful, fraudulent, or harmful activity; 

  • Transmit any unsolicited commercial communications; 

  • Attempt to gain unauthorised access to any part of the Website or its related systems; 

  • Upload or transmit viruses, malware, or any other harmful code;

We reserve the right to terminate or restrict your access to the Website at any time, without notice, if we reasonably believe you have breached these Terms. 

 

4. Orders and Purchases 

4.1 Placing an Order 

When you place an order through this Website, you are making an offer to purchase the relevant Products from Bevie Handcraft AU Pty Limited (the Seller). Your order is not accepted until you receive a written order confirmation from us. 

We reserve the right to refuse or cancel any order at our discretion, including where: 

  • Products are unavailable or out of stock; 

  • There is an error in the pricing or product description on the Website; 

  • We suspect fraudulent activity; or 

  • We are unable to verify your payment details. 

If we cancel your order after payment has been received, we will issue a full refund using your original payment method. 

4.2 Pricing 

All prices displayed on this Website are in Australian Dollars (AUD) and are inclusive of GST unless otherwise stated. Prices do not include delivery charges, which will be calculated and displayed at checkout. 

We reserve the right to correct pricing errors at any time. If the correct price of an item you have ordered is higher than the price displayed, we will contact you before processing your order. 

4.3 Payment 

Payment is required in full at the time of placing your order. We accept payment via the methods displayed at checkout. All payment transactions are processed through secure, third-party payment gateways using SSL encryption. We do not store your full credit card details. 

 

5. Shipping and Delivery 

All orders are dispatched from our Brisbane warehouse, operated by Bevie Handcraft AU Pty Limited. Delivery is carried out by third-party courier services. 

Estimated dispatch and delivery timeframes are set out in our Shipping & Delivery Policy, available on this Website. These timeframes are estimates only and we are not liable for delays caused by the courier or events outside our control. 

We do not ship to Post Office boxes. You must provide a valid street address for delivery. Once your order has been dispatched, the delivery address cannot be changed. 

Risk in Products passes to you upon delivery. If you believe your order has been lost or damaged in transit, please contact us within 48 hours of the expected delivery date at the contact details set out in clause 13 of these Terms.

6. Returns and Refunds 

Our Warranty & Returns Policy sets out your rights and our obligations in relation to returns, refunds, and exchanges. It forms part of these Terms and is available on this Website. 

In summary, subject to the ACL and our Warranty & Returns Policy: 

  • You may return Products that are faulty, not as described, or otherwise fail to meet the consumer guarantees under the ACL; 

  • Change-of-mind returns are assessed on a case-by-case basis. We are not obliged by law to accept change-of-mind returns, but where we do, Products must be returned in their original, unopened condition within 30 days of delivery, at your cost. 

 

7. Warranty 

Our Warranty & Returns Policy sets out the terms of the two-year factory warranty that applies to Kaffelogic Products purchased through this Website. Please refer to our Warranty & Returns Policy, available on this Website, for full details. 

For all warranty enquiries, your first point of contact is Bevie Handcraft AU Pty Limited. Contact details are set out in clause 13. 

 

8. Intellectual Property 

All intellectual property rights in the Kaffelogic brand, products, trademarks, trade names, logos, product designs, software, firmware, and all content associated with Kaffelogic products ("Kaffelogic IP") are owned by Kaffelogic Limited. Nothing in these Terms grants you any right, title, or licence to the Kaffelogic IP. 

All content on this Website, including but not limited to text, images, graphics, layout, and code, is either owned by or licensed to the Website Operator. You may not reproduce, copy, distribute, or commercially exploit any content from this Website without our prior written consent. 

You must not: 

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or design of any Kaffelogic product or software; 

  • Remove or alter any trademark, copyright notice, or other proprietary notice on any Product or product packaging; or 

  • Use the Kaffelogic name, logo, or trademarks in any manner without the prior written consent of Kaffelogic Limited. 

 

9. Privacy 

We are committed to protecting your personal information. Our Privacy Policy explains how we collect, use, store, and disclose your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. 

By using this Website and placing orders, you consent to the collection and use of your personal information as described in our Privacy Policy, which is available on this Website and forms part of these Terms. 

We use secure payment processing provided by third-party gateways. Credit card and payment details are encrypted using SSL technology and are not stored by us. 

 

10. Limitation of Liability 

To the maximum extent permitted by law (including the ACL), we exclude all liability to you or any third party for: 

  • Indirect, incidental, special, or consequential loss or damage of any kind;

We do not guarantee that this Website will be available at all times or free from technical errors, viruses, or other harmful components. Access to the Website may be suspended or restricted at any time without notice.
